Welcome to use the software products and related services (hereinafter referred to as "this application product") provided by Chengdu Xinyou Liangpin Technology Co., Ltd. Before using this application product, please carefully read all the contents of this "End User License Agreement" (hereinafter referred to as "this Agreement") (minors should read it under the guidance of their guardians). If you do not agree to any terms of this Agreement, please do not register and/or use (including continue to use) this game product. Otherwise, your registration and/or use (including continue to use) will be deemed that you have carefully read and fully understood all the contents of this Agreement, agreed to and accepted all the terms of this Agreement. This Agreement constitutes a legally binding agreement between you and Chengdu Xinyou Liangpin Technology Co., Ltd. regarding your use of this application product. You shall not use the defense that you have not read this Agreement or similar statements in any form thereafter.
1.1 To use this game product, users must:
(1) Carefully read and understand the product introduction of this game product, and comply with this Agreement and relevant operating rules;
(2) Provide equipment, such as personal computers, mobile phones, or other internet devices;
(3) Pay for internet access and related service fees;
(4) Comply with relevant laws and regulations of the People's Republic of China (if the user is a user outside the People's Republic of China, they shall also comply with the laws and regulations of their country or region).
1.2 When using this game product, users shall not use this game product to create, copy, publish, or disseminate the following information or links and QR codes pointing to such information:
(1) Information that infringes on others' intellectual property rights, portrait rights, reputation rights, privacy rights, and other legitimate rights and interests;
(2) Information that violates the basic principles established by the Constitution;
(3) Information that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
(4) Information that damages national honor and interests;
(5) Information that incites ethnic hatred, ethnic discrimination, or undermines national unity;
(6) Information that undermines national religious policies, promotes cults, or feudal superstitions;
(7) Information that spreads rumors, disrupts social order, or undermines social stability;
(8) Information that disseminates obscenity, pornography, gambling, violence, terror, or incites crime;
(9) Information that insults or slanders others, infringes on others' legitimate rights and interests;
(10) Information that incites illegal assemblies, associations, parades, demonstrations, or gatherings that disrupt social order;
(11) Information that operates in the name of illegal non-governmental organizations;
(12) Information that contains other content prohibited by laws and administrative regulations.
1.3 Users shall ensure that they do not engage in the following activities:
(1) Modify, translate, annotate, adapt, organize, or create derivative works based on this game product software;
(2) Copy, reproduce, disseminate, or display all or part of the program, user manual, and/or other graphic, audio, or video materials of this application product;
(3) Analyze, modify, attack, or create derivative works of this game product software through reverse engineering, reverse compilation, disassembly, or any other means;
(4) Obtain, intercept, or use the source code of this game product software and/or any information stored in this game product through any means;
(5) Create derivative or derivative works of this game product;
(6) Delete, obscure, or alter the copyright notices, trademarks, or other intellectual property notices of Chengdu Xinyou Liangpin Technology Co., Ltd. or any third party;
(7) Delete, obscure, or alter any information displayed in this game product;
(8) Exploit any technical defects or vulnerabilities in this game product to benefit oneself or others or engage in other improper activities;
(9) Use any method or means to attack the servers, routers, switches, and other equipment providing this game product software and related services to illegally obtain or modify unauthorized data, disrupt the normal service order of this game product, or engage in other harmful activities;
(10) Use this game product software and related services in an abnormal or illegal manner, maliciously damage this game product software, disrupt the normal service order, or engage in other improper activities;
(11) Create, publish, disseminate, or use any form of auxiliary tools or programs that hinder the related services of this game product;
(12) Steal or use others' accounts or passwords to log in/use this game product;
(13) Any activity that damages, disables, or affects other services of Chengdu Xinyou Liangpin Technology Co., Ltd. or burdens other services of Chengdu Xinyou Liangpin Technology Co., Ltd., or affects any other party's enjoyment of other services of Chengdu Xinyou Liangpin Technology Co., Ltd.
1.4 When using this game product, users shall not damage, disable, or affect other services of Chengdu Xinyou Liangpin Technology Co., Ltd. or burden other services of Chengdu Xinyou Liangpin Technology Co., Ltd., nor shall they affect any other party's enjoyment of other services of Chengdu Xinyou Liangpin Technology Co., Ltd. If users have any opinions or suggestions for improvement regarding this game product, they may submit them to Chengdu Xinyou Liangpin Technology Co., Ltd. Please note that by doing so, users also grant Chengdu Xinyou Liangpin Technology Co., Ltd. and third parties the right to use and incorporate users' suggestions or opinions into this game product (or third-party software) free of charge.
2.1 The specific content of the related services of this game product is provided by Chengdu Xinyou Liangpin Technology Co., Ltd. according to the actual situation. Chengdu Xinyou Liangpin Technology Co., Ltd. reserves the right to change, adjust, or terminate the provision of such services in any form at any time based on the operation of this game product. Chengdu Xinyou Liangpin Technology Co., Ltd. may also make declarations or notices regarding the content and methods of certain specific services related to this game product through any form (including but not limited to system/web announcements, system notifications, etc.), and such declarations or notices shall be deemed part of this Agreement. After such declarations or notices are published, if users continue to use this game product, it shall be deemed that users have known and agreed to the content of such declarations or notices.
3.1 When applying to become a registered user of this game product, Chengdu Xinyou Liangpin Technology Co., Ltd. has the right to require users to provide detailed, legal, and accurate personal information based on the needs of security operations, public safety, or national policies and regulations. If the information provided by users is inaccurate, untrue, or illegal and leads to Chengdu Xinyou Liangpin Technology Co., Ltd. making incorrect judgments, Chengdu Xinyou Liangpin Technology Co., Ltd. has the right to terminate users' rights to continue using this game product and pursue users' legal responsibilities.
3.2 Users agree that all data, information, and records related to the registration and use of this game product, including but not limited to registration information and related usage statistics, belong to Chengdu Xinyou Liangpin Technology Co., Ltd. (except for users' personal identity information such as name, ID number, phone number, etc.). In case of disputes, users agree that the system data of Chengdu Xinyou Liangpin Technology Co., Ltd. shall prevail, and Chengdu Xinyou Liangpin Technology Co., Ltd. guarantees the authenticity of such data.
4.1 Under the premise that users agree to and accept all the terms of this Agreement, Chengdu Xinyou Liangpin Technology Co., Ltd. agrees to grant users a revocable, non-transferable, and non-sublicensable right to use this game product software and related services for personal use only.
4.2 Unless authorized by Chengdu Xinyou Liangpin Technology Co., Ltd. in advance, users shall not use this game product for any commercial purposes or engage in any profit-making activities through or using this game product. If users wish to use this game product, or any materials, services, or software related to or derived from this game product for any commercial purposes, they shall contact Chengdu Xinyou Liangpin Technology Co., Ltd. and obtain separate authorization from Chengdu Xinyou Liangpin Technology Co., Ltd.
5.1 Chengdu Xinyou Liangpin Technology Co., Ltd. legally owns all legal rights (including but not limited to intellectual property rights) of this game product. All copyrights and other intellectual property rights of this game product software and related services, as well as all information content related to this game product, including but not limited to: text expressions and combinations, icons, patterns, colors, interface design, layout framework, relevant data, printed materials, or electronic documents, are protected by Chinese intellectual property laws and relevant international treaties.
5.2 The "Chengdu Xinyou Liangpin Technology Co., Ltd.", "This Game Product", and the logo (graphic) of "This Game Product" and/or the product and service logos of Chengdu Xinyou Liangpin Technology Co., Ltd. displayed in this game product software and related services belong to Chengdu Xinyou Liangpin Technology Co., Ltd., and users shall not use them without legal authorization.
5.3 Chengdu Xinyou Liangpin Technology Co., Ltd. and its affiliates own patent rights, trademark rights, copyrights, and other intellectual property rights related to this game product software and related services. Chengdu Xinyou Liangpin Technology Co., Ltd. and its affiliates have not granted users any intellectual property rights related to this game product through this Agreement or by providing users with this game product software and related services.
5.4 Any text, pictures, graphics, logos, audio, and/or video materials provided by Chengdu Xinyou Liangpin Technology Co., Ltd. to users in the related services of this game product are protected by copyright law, trademark law, and/or other relevant laws. Without the prior written permission of Chengdu Xinyou Liangpin Technology Co., Ltd., users shall not use them in any unauthorized manner, including but not limited to reproduction, distribution, exhibition, adaptation, compilation, publication, dissemination, sale, etc.
5.5 Users expressly agree that if this game product allows users to publish any information or content in this game product (whether to provide/open the function of publishing information/content and when to provide such function is determined by Chengdu Xinyou Liangpin Technology Co., Ltd.), Chengdu Xinyou Liangpin Technology Co., Ltd. has a worldwide, free, permanent, and irrevocable authorization and license to fully or partially use, copy, adapt, compile, publish, translate, create derivative works based on, disseminate, perform, and display such information and content, and/or incorporate all or part of such content into any works, services, or technologies of Chengdu Xinyou Liangpin Technology Co., Ltd. and/or its affiliates.
5.6 All rights not expressly granted to users in this Agreement are reserved by Chengdu Xinyou Liangpin Technology Co., Ltd. and its affiliates.
6.1 Respecting user privacy is a basic policy of Chengdu Xinyou Liangpin Technology Co., Ltd. Therefore, Chengdu Xinyou Liangpin Technology Co., Ltd. generally does not disclose, edit, or reveal users' registration information or non-public content stored in Chengdu Xinyou Liangpin Technology Co., Ltd.'s services unless Chengdu Xinyou Liangpin Technology Co., Ltd. believes in good faith that it is necessary to disclose such information, including but not limited to the following situations:
(1) As required by relevant laws and regulations;
(2) As required by relevant government authorities;
(3) As required by the service procedures of this game product;
(4) To protect public interests;
(5) To protect the legitimate rights and interests of Chengdu Xinyou Liangpin Technology Co., Ltd.;
(6) Other situations deemed necessary by Chengdu Xinyou Liangpin Technology Co., Ltd.
7.1 Chengdu Xinyou Liangpin Technology Co., Ltd. reserves the right to modify the terms of this Agreement when necessary. Once the terms of this Agreement are changed, Chengdu Xinyou Liangpin Technology Co., Ltd. will notify users through system announcements, notifications, or other methods deemed appropriate by Chengdu Xinyou Liangpin Technology Co., Ltd. Users shall promptly check and understand the modified content when using this game product. If users continue to use this game product, it shall be deemed that they agree to the modified content; if users do not agree to the modified content, they have the right to stop using this game product.
8.1 To ensure the development of the company's business, Chengdu Xinyou Liangpin Technology Co., Ltd. reserves the right to change (including but not limited to upgrading, updating, adding, reducing, deriving, etc.), interrupt, or terminate the provision of this game product software and related services at any time. Users agree to accept Chengdu Xinyou Liangpin Technology Co., Ltd.'s right to change, interrupt, or terminate the provision of this game product software and related services. If necessary, Chengdu Xinyou Liangpin Technology Co., Ltd. will notify users through system announcements, notifications, or other methods deemed appropriate by Chengdu Xinyou Liangpin Technology Co., Ltd. Users shall pay attention to and check the relevant information in a timely manner.
9.1 To the maximum extent permitted by applicable law, Chengdu Xinyou Liangpin Technology Co., Ltd. expressly disclaims any other types of warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, reliability, stability, accuracy, completeness, virus-free, and error-free. In addition, to the maximum extent permitted by applicable law, Chengdu Xinyou Liangpin Technology Co., Ltd. does not guarantee that this game product will meet users' requirements, nor does it guarantee that this game product will not be modified, interrupted, or terminated, and makes no guarantees regarding the timeliness, security, occurrence of errors, or whether information can be accurately, timely, and smoothly transmitted.
9.2 Chengdu Xinyou Liangpin Technology Co., Ltd. reserves the right to place commercial advertisements and/or any other types of commercial information in this game product.
10.1 Users agree to protect and safeguard the interests of Chengdu Xinyou Liangpin Technology Co., Ltd. and other users. Chengdu Xinyou Liangpin Technology Co., Ltd. has the right to review and supervise users' use of this game product. If users violate laws, regulations, relevant policies, or the terms of this Agreement, or if Chengdu Xinyou Liangpin Technology Co., Ltd. determines that users' account data is abnormal, Chengdu Xinyou Liangpin Technology Co., Ltd. has the right to require users to correct or directly take necessary measures (including but not limited to restricting users' account login, restricting/suspending/terminating users' activities/permissions in this game product, terminating the authorization of this application product, forcing offline, blocking accounts, modifying or deleting users' relevant information, etc.) to eliminate or mitigate the impact of users' improper behavior. In such cases, users have no right to require Chengdu Xinyou Liangpin Technology Co., Ltd. to bear any responsibility, and any legal liability or loss caused shall be borne by users themselves. The forms of legal liability and loss borne by users include but are not limited to: users shall fully compensate Chengdu Xinyou Liangpin Technology Co., Ltd. and/or its affiliates for any losses suffered, including but not limited to attorney fees, compensation fees, government penalty fees, and other infringement compensation fees.
11.1 This Agreement shall be governed by and construed in accordance with the laws of the People's Republic of China.
11.2 The place of signing of this agreement is Wuhou District, Chengdu City. In case of any disputes, both the user and Chengdu Xinyoul Liangpin Technology Co., Ltd. unanimously agree to submit the disputes to the People's Court of Wuhou District, Chengdu City for jurisdiction.
12.1 The headings in this agreement are set only for the convenience of reading and shall not affect the interpretation of any provisions of this agreement.
12.2 If any provision of this agreement is determined to be wholly or partially invalid or unenforceable for any reason, such invalid or unenforceable provision shall be replaced by an effective and enforceable provision that is closest to the obligations of the original provision, and the remaining provisions of this agreement shall remain effective and enforceable.
12.3 The failure of Chengdu Xinyoul Liangpin Technology Co., Ltd. to exercise, the failure to exercise in a timely manner, or the failure to fully exercise the rights it enjoys under this clause or in accordance with the law shall not be deemed as a waiver of such rights, nor shall it affect the right of Chengdu Xinyoul Liangpin Technology Co., Ltd. to exercise such rights in the future.
